# Plain Language Summary: Medication Affordability and Patent Integrity Act

This bill requires pharmaceutical and biotech companies to share information consistently between two government agencies: the Food and Drug Administration (FDA), which approves drugs, and the Patent and Trademark Office (PTO), which grants patents. Right now, companies can tell these agencies different things about the same drug, and there's no requirement that the information matches up. This bill closes that gap by requiring companies to certify that whatever data and claims they submit to one agency are complete and consistent with what they've told the other.

Here's what this means in practice: When a company applies to the FDA to sell a new drug, they submit clinical trial data and other evidence showing the drug works and is safe. At the same time, they're often applying to the PTO for patents on that same drug. The bill requires companies to make sure they're not telling the FDA one thing about their drug's effectiveness or safety while telling the PTO something different about the same drug to get a stronger patent. If a company submits information to the FDA about how their drug works, they must also submit that same information to the PTO, and vice versa. Companies must certify under penalty of law that their submissions to both agencies are truthful and consistent.

The bill also creates a legal defense for generic drug makers and competitors. If a patent holder failed to properly disclose information to either agency as required by this law, competitors can use that non-disclosure as a defense in patent infringement lawsuits. Additionally, the FDA cannot approve a drug application if the company hasn't complied with these new disclosure requirements. The goal is to prevent companies from gaming the patent system by selectively sharing information with different agencies, which could artificially extend their monopoly on a drug and keep prices high for consumers.
