# Plain Language Summary: Effective Assistance of Counsel in the Digital Era Act

Right now, the federal government monitors most emails and messages that incarcerated people send and receive in prison. This bill changes that by creating a special protection for communications between prisoners and their lawyers. The basic idea is simple: if you're in federal prison and you're emailing or messaging your attorney, the government shouldn't be reading those conversations. Just like a lawyer-client conversation in person is private, this bill says digital conversations should be too.

Here's what the bill actually requires: Within six months of becoming law, the Bureau of Prisons must set up a new system (or modify their existing one) that automatically excludes lawyer-client communications from monitoring. So when a prisoner sends an email to their attorney, the prison system won't be able to read the content of that message. The prison can still keep copies of these communications so the prisoner can access them later, but the government can't look at what was actually said between the lawyer and client.

There are some narrow exceptions, though. If law enforcement gets a warrant from a judge—and a high-ranking prosecutor has to approve it first—they can access these communications. But before they can actually read anything, a federal prosecutor has to review the messages to make sure they're not accidentally reading privileged attorney-client communications. That prosecutor then has to stay out of any court case involving that prisoner. This creates a safeguard so the government can't use secret surveillance of lawyer communications to build cases against defendants. If the government breaks these rules and accesses privileged communications illegally, a judge can throw out any evidence they obtained.
