# What the Choice Arrangement Act Actually Does

This bill creates a new type of employer health benefit called a "Custom Health Option and Individual Care Expense Arrangement" (nicknamed a CHOICE arrangement). Here's what that means in plain terms: employers can now give employees money to help pay for individual health insurance they buy on their own, rather than offering traditional group health plans through the company.

The key change is that employers can set aside a fixed amount of money each year—say $3,000 or $5,000—that employees can use to reimburse themselves for medical expenses while they're covered by individual health insurance they purchased themselves or through Medicare. This is different from how health benefits work today, where employers typically offer group plans that cover multiple employees together. The bill allows employers to offer this arrangement to specific groups of workers (like full-time employees, part-time employees, or those in certain locations) as long as everyone in that group gets the same deal.

For employees, this could mean more flexibility in choosing their own insurance rather than being locked into what their employer picks. However, there are strings attached: you have to actually be enrolled in individual market insurance or Medicare for the employer's money to help you. The employer gets a tax credit of $100 per employee per month during the first year they offer this arrangement, and $50 per month in the second year, which could incentivize smaller employers to set up these plans. The arrangement takes effect for plans starting in 2026, and the bill also allows employees participating in these arrangements to buy insurance through the healthcare marketplace using pre-tax money through their employer's cafeteria plan, which is currently not allowed.
