Right now, border agents can search your phone, laptop, or online accounts when you're entering or leaving the United States—without a warrant and without much legal restriction. This bill would change that by requiring law enforcement to follow the same rules at the border that they normally follow everywhere else in the country. Essentially, it says that your digital privacy matters just as much at airports and border crossings as it does at home.

Here's what would actually change if this bill becomes law. First, border agents couldn't look through your phone, computer, or email accounts without getting a warrant from a judge based on probable cause—meaning they'd need real evidence that you've committed a crime, not just a hunch. You also couldn't be denied entry to or exit from the country just because you refuse to unlock your phone or give up your passwords. The only exception would be genuine emergencies involving immediate danger to someone's life or serious national security threats, and even then, agents would have to get a warrant within seven days or destroy everything they found. If they don't get that warrant, they have to delete all copies and tell you what happened.

The bill also prevents border agents from keeping copies of your digital information unless they have probable cause to believe it contains evidence of a crime. If they access your data illegally, that information can't be used against you in any court proceeding, including immigration cases. Additionally, agents can only seize your electronic equipment if they have probable cause to believe it contains evidence related to a felony—not for minor violations. Finally, the Department of Homeland Security would have to publish annual reports showing how many times they accessed people's digital data, broken down by citizenship status and other details, so the public can see if these powers are being used fairly or if certain groups are being targeted more than others.

Protecting Data at the Border Act This bill limits government access to digital information at the border. A governmental entity may not (1) access the digital contents of electronic equipment of a U.S. person at the border without a warrant, (2) deny such a person's entry into or exit from the United States because the person refused to provide access to digital content on electronic equipment or online account information, (3) delay such a person's entry or exit for more than four hours to determine whether the person will consent to providing access to online information, or (4) seize electronic equipment from a U.S. person without probable cause to believe that such equipment contains information relevant to a felony. A governmental entity may access the contents of electronic equipment of a U.S. person without a warrant in an emergency. The entity must subsequently apply for a warrant within seven days, and if a warrant is not granted, the seized information must be destroyed and may not be disclosed. A governmental entity may not make or retain a copy of information accessed under this bill without probable cause to believe that such information relates to a crime. Information seized in violation of this bill (1) must be destroyed, (2) may not be disclosed, and (3) may not be received in evidence in any trial or government proceeding. A governmental entity shall keep a record of each instance in which it obtains access to an individual's digital information at the border.
