# Understanding the SMART Act

The SMART Act is designed to make it easier for people in rural and underserved communities to access physical therapy and occupational therapy through Medicare. Right now, Medicare has rules that limit how much physical and occupational therapy patients can receive in a year, and these limits apply everywhere equally. This bill says those limits shouldn't apply to people living in rural areas or medically underserved areas—places where there are fewer healthcare providers and people have a harder time getting care.

Think of it this way: if you live in a small town or a neighborhood where doctors and therapists are hard to find, and your doctor says you need ongoing physical therapy to recover from an injury or surgery, Medicare won't count those visits against your annual limit. This gives you more flexibility to get the treatment you need without worrying about hitting a cap. The bill also delays when these new rules take effect by a year, pushing the start date from January 2022 to January 2023, giving Medicare time to prepare for the change.

Additionally, the bill addresses supervision requirements for therapists. Currently, Medicare rules can require that physical and occupational therapists work under close supervision from a doctor or other provider. The SMART Act says that Medicare's supervision requirements can't be stricter than what individual states already require. This prevents Medicare from imposing extra red tape that could make it harder for therapists to practice and for patients to access care, especially in areas where finding supervisory staff might be difficult.

Stabilizing Medicare Access to Rehabilitation and Therapy Act or the SMART Act This bill modifies the application of a certain Medicare payment methodology for outpatient physical therapy services and outpatient occupational therapy services that are furnished by a therapy assistant. Under current law, effective January 1, 2022, payment for such services is 85% of the otherwise applicable rate. The bill delays this effective date by one year and excludes services that are furnished in rural or medically underserved areas from this payment methodology. The bill also specifies that supervision requirements for outpatient physical therapy services that are furnished through private practice may not be more stringent for purposes of Medicare coverage than under state law.
