This bill creates a new system for processing people who arrive at the U.S. southern border seeking asylum. Instead of being held in traditional detention facilities run by border patrol agents, asylum seekers would be transferred to five new "humanitarian processing centers" where they'd be evaluated by immigration officials in a different environment. The key idea is to separate the processing of asylum claims from the enforcement side of immigration, creating what supporters see as a more humane approach to handling people fleeing persecution.

Here's what would actually happen under this system: When an adult asylum seeker arrives at the border (whether at an official crossing or elsewhere), they'd be transferred to one of these centers within 12 hours. They'd then get a mandatory 72-hour rest period before being interviewed, giving them time to recover from their journey. During their stay—which would be limited to 15 days—they'd receive legal orientation, help finding a lawyer, medical and mental health screenings, and interpreters in their own language. The centers would be staffed by immigration service employees and refugee resettlement personnel, not border patrol agents, which is meant to create a less intimidating environment for interviews.

The bill also changes what happens during the actual asylum interview. Currently, officers can consider many factors when deciding if someone has a "credible fear" of persecution. Under this bill, officers would focus narrowly on whether someone actually fears persecution and would also check if they might qualify for other forms of protection, like protection for trafficking victims or special status for abused children. Importantly, anything someone says during this interview couldn't be used against them in other immigration enforcement actions. If someone is approved for further processing, they'd be released within 24 hours with a notice to appear in immigration court. If denied, they'd get a detailed written explanation and information about how to appeal.

The bill also affects people with prior deportation orders. If someone previously deported returns and expresses fear of persecution or intent to seek asylum, the government couldn't simply reinstate that old deportation order—they'd have to process them through the new system instead. This is significant because it gives people a second chance to present their case rather than being immediately removed based on an old decision.

Reimagining Asylum Processing Act of 2021 This bill modifies the processing of asylum seekers, including by establishing humanitarian processing centers along the southern border. The Department of Homeland Security must establish at least five humanitarian processing centers to process adult asylum seekers who arrive at the southern border and did not arrive as part of a family unit with minor children. The bill imposes certain requirements on these processing centers, including by (1) requiring a rest period of at least 72 hours from the asylum seeker's arrival before an asylum officer may conduct an interview to determine whether there is a credible fear of persecution, (2) limiting an asylum seeker's detention at a processing center to no longer than 15 days, (3) requiring the processing center to provide legal counsel and interpreters, and (4) requiring that appropriate nongovernmental organizations are authorized to monitor the processing centers for human rights abuses. The bill also changes the processing of asylum seekers generally, including by (1) removing provisions requiring the mandatory detention of an asylum seeker after the credible fear interview; (2) prohibiting the use of information obtained from the interview for immigration enforcement; and (3) requiring an asylum officer conducting the interview to consider whether an asylum seeker is eligible for other forms of relief, such as special immigrant juvenile status.
