# Oil Spill Response Enhancement Act of 2021

When an oil spill happens in U.S. waters, the federal government needs to hire companies to clean it up. This bill makes an important change to how the government protects those cleanup contractors from financial ruin if something goes wrong during the cleanup process.

Currently, when cleanup companies take on dangerous and complicated work to remove oil from the ocean or coastline, they can face massive lawsuits and liability claims even when they're doing everything right. This bill allows the federal government to sign contracts with these cleanup companies that include protection—called indemnification—which shields them from certain financial losses. Essentially, if a cleanup contractor gets sued for damages that happen during the cleanup work (and those damages aren't covered by their insurance), the government can use money from the Oil Spill Liability Trust Fund to cover those costs. This fund is specifically set aside for oil spill emergencies and is paid into by the oil industry.

However, the bill includes important guardrails to prevent abuse. The government won't cover costs if the contractor was the one responsible for causing the spill in the first place, if they acted with gross negligence or intentional misconduct, if they broke the terms of their contract, or if they failed to maintain required insurance. There's also a cap on how much the government will pay out per incident. The goal is straightforward: make it easier for qualified companies to step up and do the dangerous cleanup work quickly and effectively when oil spills happen, without worrying they'll be bankrupted by lawsuits, while still holding them accountable for their own mistakes.
