This bill makes it easier for people who experienced domestic violence during their marriage to collect Social Security benefits based on their ex-spouse's work record. Currently, you generally need to have been married for at least 10 years to qualify for these spousal or survivor benefits after divorce. This bill reduces that requirement to just 5 years if you can provide a court document proving you were a victim of domestic violence during the marriage.

The change applies to both men and women who are divorced and would otherwise qualify for Social Security benefits. For example, if someone was married for 7 years, experienced domestic violence, and has a court finding documenting that abuse, they could now claim benefits based on their ex-spouse's earnings record—something they couldn't do under the current 10-year rule. This is particularly important for survivors who may have left abusive relationships before reaching the 10-year mark, as it recognizes that domestic violence often forces people to end marriages earlier than they might otherwise.

To use this provision, you'd need to submit an official court document to Social Security that confirms you were a victim of domestic violence during your marriage. The law defines domestic violence using the same definition from the federal Violence Against Women Act. The changes would take effect 18 months after the bill becomes law, giving Social Security time to prepare their systems and staff to handle these cases.
