# NCAA Accountability Act of 2021: What It Actually Does

This bill is about making the NCAA follow fairer rules when it investigates colleges for breaking its regulations. Right now, the NCAA can investigate schools, athletes, and coaches pretty much however it wants. This bill would require the NCAA to follow specific procedures that give schools and people being investigated much more protection and transparency.

Here's what would actually change: When the NCAA starts investigating a school, it would have to send written notice within 60 days explaining exactly what programs are being looked at, who's involved, what rules might have been broken, and when these violations supposedly happened. Schools would also get a clear explanation of their rights during the investigation. The NCAA would only be allowed to investigate violations from the past two years, not dig back indefinitely. After eight months, if the NCAA wants to move forward with charges, it has to give the school detailed notice of what it's actually accusing them of and what punishments could result. The whole process from initial notice to a hearing would have to wrap up within one year.

The bill also adds real teeth to enforcement. If the NCAA violates these rules, the U.S. Attorney General could investigate complaints and hold hearings. If violations are found, the NCAA could face civil penalties ranging from $10,000 to $15 million. Schools being punished could also demand binding arbitration—meaning an independent panel of three arbitrators would review the NCAA's decision and could overturn it. Additionally, the NCAA would have to report annually to the Attorney General and state attorneys general about all its investigations and punishments, creating a public record of how it's enforcing its rules.

For college athletes, coaches, and school administrators, this means the NCAA's investigation process would become much more predictable and fair. You'd know what you're being accused of and have time to prepare a defense. For fans and taxpayers, it means more transparency about how college sports are actually governed and whether punishments are being handed out fairly and consistently.

NCAA Accountability Act of 2021 This bill establishes due process and notice requirements for the investigations carried out by certain intercollegiate athletic associations and related organizations. Specifically, the requirements apply to interstate athletic associations, conferences, or other organizations with authority over intercollegiate athletics or that administer intercollegiate athletics and that have at least 900 member institutions. Such organizations must establish and administer due process requirements for the investigation of any member institution, student athlete enrolled in such member institution, or other individual for infractions of the athletic association's bylaws or failure to meet the conditions and obligations of membership. The Department of Justice must establish procedures for (1) individuals and entities to file complaints, (2) the investigation of complaints that have a substantial probability of validity, and (3) the investigation of other violations of this bill.
