The FARE Act (Fair Aviation in Restrictions and Emergencies Act) addresses what happens when the federal government runs out of money and can't pay for operations. Specifically, it says that if the FAA has to restrict flights during a budget crisis, they can't shut down commercial airline flights before they shut down private jet flights in the same area. In other words, the burden of flight restrictions during a government funding lapse should fall equally on both types of aviation, not just on the airlines that carry regular passengers.

However, the bill includes important exceptions. Private jets can still fly during these budget crises if they're being used for legitimate purposes like government business, military or diplomatic missions, medical emergencies, public safety, scientific research, disaster relief, cargo delivery, or agricultural work. The FAA can enforce this rule by issuing fines or taking legal action against airlines that violate it.

The practical effect is that during a government shutdown or budget lapse, private aviation won't be singled out for restrictions while commercial airlines bear all the burden. This aims to create a more balanced approach to flight restrictions during budget emergencies, though essential government and emergency flights would still be allowed regardless.
