# What the Cell-Site Simulator Warrant Act Actually Does

This bill creates strict new rules about how law enforcement can use cell-site simulators—devices that trick cell phones into connecting to them instead of real cell towers. These devices can track someone's location and potentially intercept their communications. Right now, police can use these tools with very little oversight, but this bill would essentially ban that practice unless they get a warrant first.

Here's what changes: Police would no longer be allowed to use cell-site simulators without getting a judge's approval, similar to how they need a warrant to wiretap a phone. To get that warrant, they'd have to prove they've tried other investigative methods first and those methods either failed or seem unlikely to work. They'd also have to tell the judge exactly where they plan to use the device, how long they'll use it, and what disruptions might happen—like whether people in the area might lose the ability to make 911 calls. The warrant would only last 30 days and could be extended only if they go back to court and make the same case again.

The bill includes a narrow emergency exception for situations involving immediate danger to someone's life, organized crime, or national security threats. Even then, police would have to apply for a warrant within 48 hours. There are also exceptions for intelligence agencies following federal surveillance law and for academic research. If police use a cell-site simulator illegally, any evidence they gather can't be used in court against someone, and they'd face fines up to $250,000. Perhaps most importantly, people would have to be notified within 90 days if police used one of these devices to track their phone, so they'd finally know it happened.
