# Understanding the VOTES Act of 2023

This bill makes it easier for certain military members to vote while they're serving their country. Right now, federal voting laws only clearly cover military personnel on "active duty," but many service members work in other capacities that aren't always recognized as qualifying them for special voting protections. This bill expands the definition to include people on "active service" and those doing "inactive duty-training"—basically, it recognizes more types of military service as legitimate reasons to get absentee voting help.

The practical effect is that more military members will be able to vote by mail or through other absentee methods without jumping through extra hoops. This includes National Guard members doing training exercises, reservists on temporary assignments, and other service members whose work doesn't fit neatly into the old "active duty" category. These voters often move around frequently or work in locations that make it hard to vote in person on Election Day, so absentee voting is crucial for them to participate in elections.

The changes are straightforward—the bill updates the legal language in the existing Uniformed and Overseas Citizens Absentee Voting Act to be more inclusive of different military service statuses. It doesn't create new voting rights from scratch; it just clarifies that more service members qualify for protections that already exist. The changes take effect for elections happening after January 1, 2025, giving election officials time to update their systems and procedures before the next major election cycle.

Voting Overseas Treated Equally for&nbsp;Servicemembers Act of 2023 or the VOTES Act of 2023This bill expands the definitions of absent uniformed services voter and overseas voter for purposes of the Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA).&nbsp;UOCAVA requires that states and jurisdictions allow certain groups of citizens to register and vote absentee in federal elections. Absent uniformed services voters under UOCAVA are primarily active duty service members who are away from their voting residence. These include members of the U.S. Air Force, Army, Coast Guard, Marine Corps, and Navy. The current definition of absent uniformed services voter also includes (1) members of the merchant marine and commissioned officers of the U.S. Public Health Service and the National Oceanic and Atmospheric Administration, and (2) spouses or dependents who also are absent from their voting residence due to the member's active duty or service.This bill expands the definition of absent uniformed services voter&nbsp;to include (1) members on active service or inactive duty training who are absent from their voting residence, and (2) spouses or dependents who are absent from their voting residence due to the member's active service or inactive duty training.The bill also expands the definition of overseas voter to include an absent uniformed services voter who, by reason of active service or inactive duty training, is absent from the United States on the date of the election involved.
