The No GOUGE Act is designed to prevent companies from using tariffs as an excuse to dramatically raise prices on goods. Here's what it does: When the government imposes a tariff on imported goods or announces plans to do so, companies can only raise their prices by the amount the tariff actually costs them—plus any legitimate additional expenses they incur. They cannot use a tariff as cover to boost profits beyond what the tariff itself requires. For example, if a tariff adds $10 to the cost of a product, a company cannot raise the price by $20 and claim it's tariff-related. The law applies to imported goods, goods made in America using tariffed components, and even components themselves. It lasts for five years after a tariff takes effect. Small businesses with parent companies earning less than $100 million annually are exempt from these rules. The Federal Trade Commission (FTC) will enforce the law and can impose penalties on violators, treating violations as unfair or deceptive business practices. State attorneys general can also sue on behalf of their residents to stop price gouging and recover damages. The law includes a special provision that creates a presumption of guilt for large companies (those with $1 billion or more in annual revenue) that raise prices during periods when multiple tariffs are announced or implemented, unless they can prove the price increase is entirely justified by tariff costs.
