The BARS Act speeds up broadband and wireless infrastructure projects by removing two major regulatory hurdles: environmental reviews under the National Environmental Policy Act (NEPA) and historical preservation reviews under the National Historic Preservation Act (NHPA). Here's what that means in practical terms: when companies want to install or upgrade cell towers, fiber optic cables, or other communications equipment, they no longer have to go through lengthy federal environmental and historical impact assessments for most projects. This applies to a wide range of situations—mounting antennas on existing towers, upgrading wireless facilities, laying fiber in existing utility corridors, deploying small cell networks, and replacing damaged infrastructure after disasters. The law essentially says these types of communications projects are no longer considered "major federal actions" that trigger these review requirements. However, the bill includes an important safeguard: the FCC still must evaluate radiofrequency (RF) exposure safety. The law also creates a 45-day deadline for Native American tribes to respond to project notifications—if a tribe doesn't respond within that timeframe, they're presumed to have no objection, though tribes can challenge this presumption if they can show the company didn't make a good faith effort to contact them. The goal is to get broadband infrastructure built faster while still protecting public safety and giving tribes a voice in projects affecting their lands.
