Some poppy seeds sold in the United States contain dangerous levels of morphine and other opioid compounds that can make people seriously ill or even cause death. This bill aims to stop that from happening by prohibiting the sale of contaminated poppy seeds to consumers. The contamination occurs naturally when poppy seeds aren't properly cleaned before being sold—the seeds can pick up morphine and related compounds from the plant itself. Studies have shown that some poppy seed products contain extremely high levels of these opioids, with some samples containing up to 2,788 milligrams of morphine per kilogram of seeds. To put this in perspective, medical research shows that even 20 to 50 milligrams of morphine per day significantly increases overdose risk for patients taking it as prescribed medication.

The bill was named after Stephen Hacala, a 24-year-old from Arkansas who died from morphine poisoning caused by eating contaminated poppy seeds. At least 18 other people in the U.S. have also died this way. Beyond deaths, the contamination has caused other serious problems: pregnant women have tested positive for opiates during childbirth due to eating poppy seed foods, leading to investigations by child welfare officials. Military servicemembers have even been warned by the Department of Defense to avoid poppy seeds because the contamination can cause them to fail drug tests.

The good news is that effective cleaning processes already exist that can reduce morphine contamination from dangerous levels down to safe amounts. Under this bill, the government has one year to propose safety standards for how much morphine and similar compounds are acceptable in poppy seeds, and two years to finalize those standards. Once those standards are set, companies won't be allowed to sell poppy seed products—whether pure seeds or foods containing them—that exceed those limits. This means consumers buying poppy seed bagels, muffins, or other foods should no longer face the risk of accidental opioid poisoning from their breakfast.
