This bill addresses a financial problem that affects military members who leave the service and later become disabled. Here's what's happening: When service members are discharged from the military, they sometimes receive separation pay—a lump sum of money to help them transition to civilian life. The current law allows the military to take back this separation pay if those same people later receive disability benefits from the Veterans Affairs department. This bill stops that practice entirely and puts new limits on when the military can recoup separation payments in other situations.

The main change is straightforward: if you received separation pay when you left the military and then later qualify for disability compensation from the VA, the military can no longer demand that money back. This applies to all types of separation payments, including special separation benefits and voluntary separation incentives. The bill also protects the amount of disability benefits you receive—the VA cannot reduce your disability payments just because you got separation pay. For many veterans, this means keeping money they were promised twice over instead of having to choose between one benefit or the other.

The bill does place some limits on recoupment in other situations. If a former service member receives retirement pay (rather than disability benefits), the military can still recoup separation pay, but only up to 25 percent of their monthly retirement check unless the person agrees to a faster repayment schedule. The military also has to give 90 days' notice before starting to deduct money, must consult with the veteran about repayment rates, and can waive the requirement entirely if it would cause financial hardship. These protections ensure that veterans aren't left struggling financially while the government recovers its money.

Restore Veterans' Compensation Act of 2022 This bill eliminates the recoupment of separation pay, special separation benefits, and voluntary separation incentive payments from members of the Armed Forces who subsequently receive disability compensation from the Department of Veterans Affairs. In addition, the bill limits recoupment of such pay from service members who subsequently receive military retired or retainer pay.
