# Immigration Transparency and Transit Notification Act of 2022

This bill requires federal immigration agencies to give states advance warning before moving or placing immigrants without legal status into their jurisdictions. Specifically, the Department of Homeland Security and Department of Health and Human Services must notify state governors, attorneys general, local officials, and law enforcement at least seven days before transporting or placing any undocumented immigrant or unaccompanied child in a state. The notification must include detailed information about each person, including their name, date of birth, country of origin, any criminal history, biometric data, and information about their sponsor if they have one.

The bill gives state governors significant power to block these placements. Within three days of receiving notification, a governor can submit a written objection, and if they do, the federal government cannot place that immigrant in their state and must find an alternative location instead. The only exception is for unaccompanied children being reunited with family members, which can proceed regardless of a governor's objection. This means states would have a veto power over federal immigration placement decisions, fundamentally changing how the government manages where immigrants go after they're apprehended or processed.

The bill also requires the federal government to submit quarterly reports to Congress detailing all notifications sent to states, all objections received, and information about any private companies helping with the transportation of immigrants, including how much federal money was spent. This transparency requirement is meant to create a public record of immigration movements across the country and track which private contractors are involved in transporting immigrants between states.

Immigration Transparency and Transit Notification Act of 2022 This bill requires notifications to certain officials before an unaccompanied alien child or a non-U.S. national (alien under federal law) without lawful immigration status may be placed in or transported to a state or local jurisdiction. The bill also authorizes the office of the governor of the relevant state to prohibit the placement or transportation. At least seven calendar days before taking such an action, the Department of Homeland Security (DHS) or the Department of Health and Human Services (HHS) must notify (1) the relevant state governor's office, (2) the state attorney general's office, (3) the county or municipal government, (4) local law enforcement, and (5) federal and state legislators representing the relevant jurisdiction. The action may not take place if the state governor's office objects no later than three calendar days after receiving the notification. This authority to object shall not apply if the action is to place an unaccompanied child with, or transport the child to, a family member.
