This bill ensures that nursing home residents can have a designated family member or caregiver visit them even during emergencies when regular visitation is restricted—like what happened during the COVID-19 pandemic. The bill applies to skilled nursing facilities, regular nursing homes, facilities for people with intellectual disabilities, and inpatient rehabilitation facilities that receive Medicare or Medicaid funding.

Here's what it does: Each resident (or their legal representative if they can't decide) gets to pick at least one "essential caregiver" who can visit every single day, at any time, even when the facility has locked down due to a public health emergency or government order. These caregivers must follow the same safety rules as the facility's staff—nothing more restrictive. Facilities can only deny access for up to 7 days initially, and possibly 7 more days if the state health department approves, except for residents who are dying or in serious decline (they always get access). If a facility wrongly denies access, residents and caregivers can appeal to the state, which must investigate within 2 business days. Facilities that violate these rules face fines up to $5,000 and must create a plan to fix the problem.

The bill is a direct response to what happened during COVID-19, when nursing home residents were isolated from family members, leading to serious health declines including depression, weight loss, and increased use of psychiatric medications. The law recognizes that family caregivers provide essential support that staff shortages can't replace.
