# What the Prescription Drug Rebate Reform Act Actually Does

Right now, when you pick up a prescription, your insurance company might charge you a percentage of the drug's list price—that's the official sticker price before any discounts. Here's the problem: your insurance company and the pharmacy benefit manager handling your prescription often negotiate secret rebates and discounts with drug manufacturers, but you don't benefit from those savings. You still pay your percentage based on the full list price, even though your insurance company is actually paying much less. This bill changes that system.

Starting in 2025, insurance companies will have to base your out-of-pocket costs on the actual net price they're paying for the drug—meaning the list price minus all those negotiated rebates and discounts—rather than the inflated list price. So if a drug's list price is $100 but your insurance company negotiated it down to $60, you'd pay your percentage of the $60, not the $100. This only applies when you're paying coinsurance (a percentage of the cost), and only if you're either still working toward your deductible or have other coinsurance obligations. The rule doesn't kick in if the list price and net price are essentially the same (within a penny).

The bill still allows insurance companies to charge you flat copays—like a straight $30 for a prescription—since those aren't tied to percentages. Essentially, this reform tries to make sure that when insurance companies negotiate better drug prices, you actually see those savings reflected in what you pay at the pharmacy counter, rather than having those savings disappear into the system while you're stuck paying based on the original sticker price.
