The No Political Enemies Act is designed to prevent federal officials from using government enforcement powers against people or organizations primarily because of their political speech, criticism, or participation in political activities. The bill establishes that the President cannot designate domestic terrorist organizations and affirms that all federal employees must respect First Amendment rights.

Under this law, if someone is prosecuted, investigated, or regulated by the federal government and they can show that their protected political speech was a motivating factor in that action, they gain significant legal protections. The government would then have to prove by clear and convincing evidence that legitimate, non-political reasons justify the enforcement action. If the government can't meet this burden, the case gets dismissed. This applies to criminal prosecutions, civil lawsuits, tax investigations, and regulatory actions.

People targeted by government actions they believe are politically motivated can sue federal officials for damages and seek court orders to stop the action. If they win or substantially prevail, the government must pay their legal fees. The bill also prevents federal agencies from spending money on enforcement actions that are substantially motivated by protected speech, and it requires the Justice Department to report quarterly to Congress about significant investigations and prosecutions, including the reasoning behind decisions to pursue or decline cases.
