# Student Mental Health Rights Act: What You Need to Know

This bill directs the federal government to study how colleges handle mental health and substance use issues, and to create clear guidance for schools about their legal obligations to students struggling with these conditions. Right now, many colleges lack consistent policies for supporting students with mental health disabilities, and this bill aims to fix that by gathering data and providing schools with clear rules about what they must do under existing disability laws.

The bill requires the Secretary of Education to complete a study by June 2023 examining how widespread mental health and substance use conditions are among college students, what policies schools currently have for students taking leaves of absence due to these conditions, and what practices work best for helping students manage their conditions while staying in school. The study will look at whether current policies actually help students graduate or if they're pushing students out unnecessarily. This information will be reported to Congress so lawmakers can understand the real scope of the problem.

At the same time, the bill requires the Education Department to issue guidance explaining how existing disability laws—specifically the Americans with Disabilities Act and the Rehabilitation Act—apply to college students with mental health and substance use conditions. This guidance will clarify what accommodations colleges must provide, what policies might unfairly discriminate against students with these conditions, and how schools should handle situations where students need to take time off or return to campus. The bill essentially says that colleges can't just kick students out or make it impossible for them to come back just because they're dealing with mental health or addiction issues—they have to follow the same disability protections that apply to other disabilities.

Student Mental Health Rights Act This bill addresses mental health and substance use at institutions of higher education (IHEs). Specifically, the bill requires the Department of Education (ED)&nbsp;to conduct a study on mental health conditions and substance use conditions at IHEs. In addition, ED must&nbsp;issue guidance on&nbsp;IHEs' (1) compliance&nbsp;with&nbsp;federal law on mental health, (2) legal obligations to&nbsp;students with mental health conditions and students with substance use conditions, and (3) policies that may have a discriminatory impact on such students.
