The SELF DRIVE Act of 2026 creates a comprehensive federal framework for regulating self-driving cars in the United States. Right now, there's no clear national standard for how autonomous vehicles should be tested and approved, so this bill fills that gap by giving the National Highway Traffic Safety Administration (NHTSA) the power to set safety rules for vehicles with automated driving systems.

Here's what the bill does in practical terms: Any company that wants to sell a self-driving car or the autonomous driving system itself must first develop a "safety case"—basically a detailed document proving that their technology won't cause unreasonable accidents, deaths, or injuries. This safety case has to explain how the car's hardware and software work, what sensors it uses, how it handles emergencies, how it protects pedestrians and cyclists, and how it protects against cyber attacks. The Secretary of Transportation has until September 30, 2027, to write the official rules spelling out exactly what needs to be in these safety cases.

The bill also creates a national database to collect information about crashes involving self-driving cars. When an autonomous vehicle is involved in a serious crash (one with injuries, fatalities, airbag deployment, or hitting a pedestrian), the manufacturer has to report it to NHTSA within 30 days. This data will help regulators spot problems and trends. Additionally, the bill prevents individual states from banning self-driving cars or creating their own conflicting rules—instead, there's one federal standard. However, states can still enforce their own traffic laws, vehicle registration requirements, and consumer protection laws.
