# The PREPARE Act: What It Actually Does

This bill creates a special commission to figure out how the federal government could regulate cannabis the same way it regulates alcohol. Right now, cannabis is illegal at the federal level even though many states have legalized it for medical use or adult recreation. The bill essentially says: "Let's study how to make this work" and sets up a group of experts to come up with recommendations.

The commission would be made up of 23 members, including federal agency leaders, medical experts, people who were previously incarcerated for cannabis offenses, cannabis business operators, and state regulators. They'd have one year to study the issue and publish recommendations. The commission would look at major problems created by current cannabis laws—like how cannabis businesses can't access banks, how research is blocked, how criminal records have harmed communities (especially minorities), and how to set up safety standards for products. They'd also figure out how to handle taxes, interstate trade, and making sure hemp and cannabis crops don't interfere with each other.

The bill doesn't actually legalize cannabis or change any current laws. It's purely a fact-finding mission. The commission would hold public hearings, take comments from industry people and advocates, and publish their findings online. Congress and the President could then use these recommendations to decide whether and how to change federal cannabis law in the future. Importantly, the commission has no power to make rules or enforce anything—they can only advise.

Preparing Regulators Effectively for a Post-prohibition Adult-use Regulated Environment Act of 2022 or the PREPARE Act of 2022 This bill directs the Department of Justice to establish the Commission on the Federal Regulation of Cannabis to study a plausible and prompt pathway to cannabis regulation.
