This bill creates a new federal system for extreme risk protection orders—court orders that temporarily remove firearms from people who pose an immediate danger to themselves or others. Here's how it works: Family members or law enforcement officers can ask a federal district court to issue these orders. The court can issue an emergency order the same day (or next business day) if there's probable cause to believe someone poses an imminent risk of harming themselves or another person with a gun. That emergency order lasts up to 14 days. For a longer-term order lasting up to 180 days, the court must hold a hearing where the person can defend themselves with a lawyer (provided free if they can't afford one). The person asking for the order must prove by clear and convincing evidence that the risk exists. When an order is issued, the person must surrender all their firearms, ammunition, and gun permits to federal marshals or designated law enforcement officers within 48 hours. If the order expires or is dismissed and the person is legally allowed to own guns again, their firearms are returned.
