The FLASH Act of 2025 gives the federal government's health emergency response agency (called BARDA) more flexibility and speed when buying medical supplies and developing new health products. Normally, the government has to go through lengthy competitive bidding processes for big purchases, but this law lets them skip those requirements in certain situations to move faster during emergencies.

Specifically, the law allows the government to buy supplies for testing and developing new medical products without competitive bidding. It also lets them award follow-up production contracts to companies they've already worked with on prototype development, again without having to open it up to other bidders. Additionally, the government can now purchase innovative commercial products and services through a streamlined process that still involves competition but is faster than traditional methods.

There are some guardrails built in: for contracts over $100 million, the government has to write down why they think this purchase will actually work and meet their needs. They also have to notify Congress within 45 days of awarding any contract over $100 million, explaining what they bought, why they needed it, how much it cost, and who they bought it from. The goal is to help the government respond more quickly to public health threats by cutting through red tape while still maintaining some oversight and accountability.
