This bill changes how the federal government treats temporary doctors and advanced medical practitioners who work on a 'locum tenens' basis—meaning they fill in temporarily at healthcare facilities for short periods. Right now, these temporary medical professionals are often treated as regular employees under federal labor laws, which means healthcare facilities have to follow rules about minimum wage, overtime, benefits, and other employee protections. This bill says that temporary doctors, nurse practitioners, physician assistants, and similar providers should be treated as independent contractors instead of employees, as long as they work at one location for no more than one continuous year and have a written agreement with the facility. This means healthcare facilities won't have to provide them with employee benefits, follow overtime rules, or comply with certain labor protections. The bill is designed to make it easier and cheaper for rural and underserved areas to hire temporary medical staff to fill staffing gaps. However, the bill specifically says it doesn't change tax rules, Social Security benefits, unemployment insurance, or Medicare/Medicaid reimbursement—those programs will continue to treat these workers according to their own separate rules.
