This bill tightens the rules for who can legally import goods into the United States. Right now, almost anyone can be listed as the "importer of record" (the person officially responsible for bringing goods into the country), which creates accountability problems. This law changes that by requiring importers to be either U.S. citizens or permanent residents if they're individuals, or if they're companies, they must have a real physical office in the U.S. and at least one U.S. citizen or permanent resident owner or employee. Foreign companies can still import through their U.S. subsidiaries if those subsidiaries meet these requirements. The bill also requires importers to pay all duties and taxes directly to U.S. Customs through electronic bank transfers from accounts verified under anti-money laundering rules. This makes it much harder to hide who's actually importing goods or to use shell companies and fake addresses. The law includes an exception for major shipping companies like FedEx and UPS that employ hundreds of thousands of people—they can use licensed customs brokers to handle imports on their behalf. Customs and Border Protection gets one year to write detailed rules about how to verify importers meet these new requirements and what penalties apply for lying or leaving things out.
