# The GUARD Act: What It Actually Does

The GUARD Act is designed to prevent federal officials and candidates from accessing classified government secrets while they're facing criminal charges for serious national security crimes. If someone who works for the government, serves in Congress, is in the military, or is running for federal office gets charged with crimes like stealing classified documents, improperly handling national defense information, obstructing an investigation, or acting as a foreign agent, they would lose their access to classified information during the time they're being prosecuted.

This ban would stay in place from the moment charges are officially filed against someone all the way through their trial. It ends only when the charges are dismissed or the person is found not guilty. The idea behind this is straightforward: if someone is accused of mishandling secrets or compromising national security, the government shouldn't give them access to more secrets while the case is ongoing. This prevents someone facing these serious charges from potentially accessing, copying, or leaking additional classified material while their case is still active.

There is one escape hatch built into the bill. Congress could vote to waive this restriction if they wanted to. A majority of the House and two-thirds of the Senate would need to agree to let someone keep their classified access despite being charged with these crimes. This would be a very high bar to clear, making such waivers extremely unlikely in practice.

The law would apply broadly to everyone in government—from the President and Vice President down to regular federal employees, members of Congress, military personnel, and anyone running for federal office. Essentially, no one would be exempt from this rule, though the waiver option means Congress retains the final say if they believe an exception is warranted in a particular situation.
