This bill, called the Safe Staffing Saves Lives Act, sets new minimum staffing requirements for nursing homes and skilled nursing facilities that accept Medicare and Medicaid patients, starting January 1, 2029. Beginning that date, these facilities must ensure each resident receives at least 4.1 hours of nursing care per day, broken down into specific amounts: 1.3 hours from licensed nurses (with 0.75 hours from registered nurses and 0.55 hours from licensed practical nurses) and 2.8 hours from nursing aides. Facilities must also have a registered nurse on-site 24 hours a day, 7 days a week. The bill applies to both Medicare-funded skilled nursing facilities and Medicaid-funded nursing facilities. Facilities that fail to meet these staffing levels will face serious consequences: they can lose Medicare and Medicaid payments, must post notices at their entrances and inform residents and families that they don't meet standards, and will be inspected more frequently. The bill does allow temporary waivers of up to 180 days if a facility can prove it cannot reasonably meet the requirements due to local workforce challenges, but facilities with serious safety violations or recent harm to residents cannot receive waivers. Facilities also cannot transfer or discharge residents just to meet the staffing requirements. The bill requires nursing homes to start reporting detailed information about staff hours worked by January 1, 2027, and directs the government to study the impact of these new staffing levels on resident safety, care quality, and nursing staff wages and retention, with reports due by 2034 and every five years after.
