The bill aims to change this by making data center companies responsible for their own energy costs and infrastructure needs.

The legislation creates a "data center load queue" system—essentially a waiting list that prioritizes data centers that bring their own clean energy sources to the grid or agree to reduce their power use during peak demand times. Data centers that don't meet these requirements could face delays or denials of grid connection. The bill also requires states to create special electricity rate classes for data centers so that these companies pay the full cost of serving their operations, rather than spreading those costs to regular utility customers. Additionally, the bill includes labor protections requiring that construction workers on data center projects be paid prevailing wages and that apprenticeship programs be used.

The Federal Energy Regulatory Commission (FERC) is tasked with writing the rules to implement these requirements, and states must consider creating data center-specific rates within two years. The goal is to ensure that as data centers consume more and more electricity—projected to double by 2028—they pay their fair share rather than having their costs subsidized by ordinary ratepayers.
