This bill guarantees that nursing home residents can have a designated family member or close friend—called an "essential caregiver"—visit them every single day, even during emergencies when the facility restricts regular visiting hours. The law applies to skilled nursing facilities, regular nursing homes, facilities for people with intellectual disabilities, and rehabilitation centers.

The core idea comes from what happened during COVID-19, when nursing homes locked down completely and residents couldn't see family members. The bill's sponsors point out that during those lockdowns, nursing home residents experienced serious health declines—pressure ulcers increased 31 percent, significant weight loss rose 49 percent, and depression symptoms jumped 40 percent. The bill aims to prevent that kind of isolation from happening again by ensuring at least one designated caregiver can visit daily and help with things like eating, bathing, emotional support, or just being present with their loved one.

Here's how it works in practice: Each resident (or their legal representative if they can't decide) gets to name one or more essential caregivers. During any emergency when the facility restricts normal visiting—whether due to a disease outbreak, natural disaster, or government order—that designated caregiver can still come in every day. The facility can only temporarily block access for the first seven days of an emergency, and can extend that to 14 days only if the state health department approves. After that, the caregiver must be allowed in. If a facility wrongly denies access, residents and caregivers can appeal, and the state has 48 hours to investigate and decide. If the facility violated the rules, it must allow immediate access and can face fines up to $5,000 if it doesn't fix the problem.

The only way a facility can permanently ban an essential caregiver is if that person breaks safety rules—like refusing to wear a mask during a disease outbreak. But the facility must give written warning first, explain exactly what the person did wrong, and give them a chance to fix it. If the caregiver still won't comply after that warning, only then can they be banned, and the facility must explain why in writing within 24 hours.
