# Food Safety Administration Act of 2022

This bill creates a brand new federal agency dedicated entirely to food safety, separating it from the current Food and Drug Administration (FDA). Right now, the FDA handles both food safety and drug safety under one roof. This bill would split those responsibilities, creating a standalone Food Safety Administration with its own leader and staff focused exclusively on keeping food safe.

The new agency would take over all the food-related work currently done by the FDA, including inspecting food facilities, checking for contamination, reviewing food additives, monitoring pesticide residues, and responding to foodborne illness outbreaks. It would also handle international food safety discussions and work with state and local health departments. The bill requires the new agency to categorize food facilities as high-risk, intermediate-risk, or low-risk, then inspect them accordingly—high-risk facilities at least once a year, intermediate ones every two years, and low-risk ones every three years. Infant formula plants would get the most attention, with inspections every six months.

The bill also adds new requirements for food manufacturers. Companies that make infant formula or essential medical foods (specialized products for people with specific medical conditions) would have to notify the government within five business days if they discover a problem that could cause a shortage. Additionally, the bill requires the new agency to finalize rules making it easier to trace food products back to their source, which helps during recalls and contamination investigations. The agency would also need to follow up with facilities within 30 days after finding violations during inspections to verify they've fixed the problems.

Food Safety Administration Act of 2022 This bill splits the current Food and Drug Administration into the Federal Drug Administration (to regulate drugs, cosmetics, devices, biological products, color additives, and tobacco) and the Food Safety Administration (to regulate food safety). The bill also establishes specific requirements with respect to manufacturers of infant formula, such as requiring manufacturers to notify the newly created Food Safety Administration of potential infant formula shortages.
