This bill makes it easier for people to sue companies for price-fixing and other anticompetitive behavior. This bill changes that by saying you can win a case by showing that companies engaged in 'parallel conduct' (acting similarly on prices or output) plus at least two other suspicious factors, without needing to prove they directly communicated or conspired. Those suspicious factors could include things like companies meeting at industry conferences, sharing pricing information, suddenly changing their pricing methods, or operating in a market where collusion is easy (like when there are only a few competitors or products are basically identical). The bill applies to cases brought by the federal government, the FTC, state attorneys general, and private citizens seeking damages or court orders to stop the behavior. Importantly, it changes the legal standard so that at early stages of a lawsuit, judges only need to decide if the allegations are plausible—not whether the company's explanation for independent action is equally plausible. At trial, judges must let juries decide if there's enough evidence of conspiracy, rather than throwing out cases early.
