# Understanding the Asbestos Exposure in Housing Reduction Act of 2024

This bill requires sellers and landlords to tell buyers and renters about asbestos in homes built before 2019. Asbestos is a dangerous material that was commonly used in insulation, floor tiles, roofing, and other building materials for decades. When asbestos gets disturbed or deteriorates, it releases tiny fibers that people can breathe in, which can cause serious lung diseases and a type of cancer called mesothelioma. Right now, there's no federal requirement to disclose asbestos hazards when selling or renting homes, so many people unknowingly move into properties with this health risk.

Under this bill, before you're locked into buying or renting a home, the seller or landlord must tell you about any asbestos they know about and give you any inspection reports they have. You'd also get at least 10 days to hire an inspector to check for asbestos yourself before you're legally bound to the purchase or lease. Every contract would include a warning statement explaining the asbestos risks and reminding you that inspections are recommended. Real estate agents would be responsible for making sure sellers and landlords follow these rules.

If someone knowingly violates these requirements, they face serious consequences. They could be fined, sued for three times the actual damages you suffered, and forced to pay your legal fees and expert witness costs if you win in court. The bill also makes violations enforceable under existing environmental laws, with penalties up to $10,000 per violation. The regulations would take effect two years after the bill becomes law, giving the Department of Housing and Urban Development and the Environmental Protection Agency time to write the detailed rules about how this disclosure process works.
