This bill requires health insurance plans that cover pregnancy and childbirth to also cover infertility treatments. If your employer-sponsored health plan currently pays for obstetrical services (pregnancy care), it would now have to pay for fertility treatments like in vitro fertilization (IVF), egg freezing, and other procedures aimed at helping people conceive. The bill also covers fertility preservation services—meaning if someone needs cancer treatment, chemotherapy, radiation, or surgery that might damage their ability to have children, their insurance would cover egg or sperm freezing before that treatment happens.

The coverage would apply to people diagnosed with infertility, which the bill defines broadly to include anyone who can't get pregnant after a year of trying, anyone who has been told by a doctor they can't have biological children, or anyone with specific reproductive disorders. Insurance companies can still require pre-authorization (getting approval before treatment) and can charge copays and deductibles, but these restrictions can't be stricter than what they apply to other medical treatments. Insurance companies are also prohibited from paying doctors less or offering incentives to discourage fertility treatments, and they can't stop doctors from discussing these options with patients.

The bill includes significant oversight requirements. For the first five years, insurance companies must document and submit detailed analyses showing that any restrictions they place on fertility coverage are applied fairly and consistently with medical guidelines. If the government finds an insurance company isn't complying, the company has 45 days to fix the problem or face penalties of up to $100 per day for each person wrongly denied coverage. The rules take effect starting January 1, 2026, giving insurance companies time to adjust their plans.
