Right now, the same consulting firm could potentially work for both the FDA and a pharmaceutical company at the same time, which creates an obvious problem: the consultants might be tempted to help their private clients get favorable treatment from the FDA rather than giving the FDA honest, independent advice.

The bill requires FDA contractors to continuously report any conflicts of interest throughout their contract period and get written approval before taking on new side work that could create conflicts. More importantly, it prevents consulting firms from having the same employees work for both the FDA and private companies that the FDA regulates (like drug manufacturers or medical device makers). For example, a consultant couldn't spend half their time helping the FDA evaluate a drug application and the other half helping the company that makes that drug. There are narrow exceptions if the FDA leadership determines there's a "compelling reason" to allow it, but those exceptions must be publicly posted on the FDA website within two weeks, explaining why the exception was granted and what safeguards are in place.

The bill also requires the FDA to publicly announce any waivers it grants for organizational conflicts of interest within 14 days, including details about what conflicts exist and how the contractor plans to manage them. This transparency is meant to let the public see when the FDA is making exceptions to these conflict-of-interest rules. The FDA has 18 months from when this bill becomes law to write the detailed regulations explaining how all these requirements will actually work in practice.
