This bill gives tenants in federally-funded apartment buildings much stronger tools to hold landlords accountable for maintaining safe, livable housing. Right now, if a landlord lets a building fall into disrepair, tenants have limited ways to force action. The bill creates several new tenant protections. If a building fails safety inspections or has serious maintenance violations, tenants can now withhold their portion of the rent and put it into an escrow account (essentially holding it in trust) until the landlord makes repairs. Tenants can also pay for urgent repairs themselves and deduct the cost from their rent. Landlords are explicitly prohibited from evicting tenants for using these rights. Additionally, if just 25 percent of residents sign a petition, they can demand that the government conduct an inspection or review of their building—they don't have to wait for the government's regular schedule. The bill also prevents the government from cutting off rental assistance during foreclosures, ensuring tenants aren't suddenly left without subsidies if the building changes ownership.

The bill also increases transparency and tenant involvement in inspections. Landlords must post inspection notices and results in common areas so residents know what's being checked and what was found. Tenant organizations can submit reports to inspectors before visits, accompany inspectors during common area inspections, and suggest additional units to be checked. Tenants get the same appeal rights as landlords if they disagree with inspection results. Finally, the bill requires the government to fund nonprofit organizations that help tenants organize and understand their rights, and it requires HUD to make building financial records and inspection reports available to legitimate tenant associations so they can see how their building is being managed and whether money is being properly spent on maintenance.
