# Understanding the Tribal Child Welfare Support Act

This bill makes sure that Native American tribes and tribal groups get dedicated federal funding to help care for children in their communities. Right now, the law allows the federal government to give money to tribes for child welfare services, but it's optional—the government can choose to do it or not. This bill changes that by requiring the government to set aside 3 percent of child welfare funding specifically for tribes and tribal organizations, making it mandatory rather than optional.

The money would go directly to tribal organizations to use for their own child welfare programs. This is important because Native American tribes have their own legal systems and often want to handle child welfare cases within their communities rather than having state governments take over. When a child needs protection or support, tribes can now count on receiving a guaranteed portion of federal funding to provide those services themselves. The bill also clarifies that if a tribe is part of a consortium (a group of tribes working together), the money can be distributed among the participating tribes as they decide.

There's one important catch: this funding set-aside only kicks in if the total federal child welfare budget grows to at least 103 percent of what was available in 2024. This protection ensures that states don't lose money they currently receive. If the budget doesn't grow enough, the 3 percent wouldn't be reserved, and instead, tribes would receive funding as part of their state's regular allocation. Essentially, the bill tries to expand tribal control over child welfare services without taking money away from states that already depend on this funding.
