# Plain Language Summary: Enhanced Regulatory Flexibility Assessment Act

This bill makes government agencies do more thorough homework before creating new rules that affect small businesses. Right now, when federal agencies write new regulations, they're supposed to consider how those rules will impact small companies, but the law doesn't require them to be very detailed about it. This bill tightens those requirements by forcing agencies to provide much more comprehensive analysis and documentation of their findings.

Specifically, the bill requires agencies to give detailed explanations about several things before and after they finalize a new rule. They need to clearly describe why they're creating the rule, estimate exactly how many small businesses will be affected and what types they are, and carefully explain what paperwork and compliance costs small companies will face. Agencies also have to identify any other existing rules that might overlap or conflict with their new rule, estimate how much extra burden this new rule adds on top of what small businesses already deal with, and specifically address whether the rule will hit certain types of small businesses harder than others. Additionally, they must explain whether the rule will make it harder for small businesses to get loans or credit.

The bill also requires agencies to make their final analysis publicly available on their websites, not just in the Federal Register, so small business owners can actually find and read this information. When agencies claim a rule won't significantly affect small businesses and therefore don't need to do a full analysis, they now have to provide a detailed written explanation with economic evidence backing up that claim. Finally, the bill requires agencies to use actual numbers and data when describing impacts, or if that's not possible, to explain in detail why they can't provide specific numbers.

The practical effect is that creating new regulations will take longer and require more work from government agencies, but small business owners and advocates will have better information about how proposed rules might affect them before those rules become final.
