# The NO BAN Act: What It Does and Why It Matters

The NO BAN Act is designed to restrict the President's power to ban or limit entry to the United States based on nationality or religion. Right now, the President has broad authority to suspend entry for groups of people if they claim it's necessary for national security. This bill would significantly narrow that power and add new requirements before any such ban could take effect.

Currently, a President can issue a travel ban fairly quickly with minimal oversight. This bill changes that by requiring the Secretary of State and Secretary of Homeland Security to first consult with Congress and provide specific evidence explaining why the ban is necessary. They would have to show that the ban targets a genuine security threat, not just a particular country or religion. The bill also requires that any ban be as narrow as possible—meaning it should only restrict the specific group causing the problem, not entire nationalities. Additionally, the bill creates a strong presumption that people with family ties in the U.S. or humanitarian reasons should be granted exceptions to any ban.

The bill also adds a transparency requirement: within 48 hours of issuing any ban, the administration must brief Congress and publish details in the Federal Register explaining what they're doing and why. If they don't provide this information within two days, the ban automatically ends unless Congress votes to keep it in place. People affected by a ban could also sue in federal court to challenge it. Finally, the bill expands existing anti-discrimination protections in immigration law to cover all visa types and explicitly includes religion as a protected category, making it illegal to discriminate based on someone's faith when deciding who can enter the country.
