# Understanding the PROTECT Act of 2024

This bill gives Native American tribal courts and law enforcement agencies stronger legal tools to fight the opioid and drug crisis on tribal lands. Right now, tribal courts have limited power compared to state and federal courts when it comes to investigating drug crimes and pursuing criminals who use electronic communications to distribute drugs. This bill levels the playing field by allowing tribal courts to obtain search warrants for emails, text messages, and other electronic communications using their own court procedures, just like state courts can.

The bill also expands what crimes tribal courts can prosecute. Currently, tribal courts can only handle certain offenses, but this legislation adds drug trafficking, drug-related crimes, and firearms offenses to their jurisdiction. This means if someone manufactures, delivers, or possesses illegal drugs on tribal land—or uses a firearm while committing a crime—tribal courts can now prosecute them directly rather than having to rely solely on federal prosecutors. The bill defines these crimes broadly to include controlled substances, counterfeit drugs, and drug paraphernalia, as well as firearms used in crimes or possessed by people convicted of domestic violence.

Additionally, the bill ensures that when tribal courts convict someone of these serious crimes, the federal Bureau of Prisons can house those prisoners in federal facilities if needed, rather than forcing tribes to manage all incarceration themselves. This is practical because many tribal communities don't have the resources to build and operate large prison systems. By allowing federal prison placement for serious offenders convicted under tribal authority, the bill helps ensure public safety while respecting tribal sovereignty and giving tribal justice systems real teeth to combat drug trafficking that devastates Native communities.
