# Understanding the Offshore Oil and Gas Worker Whistleblower Protection Act

This bill creates legal protections for workers in the offshore oil and gas industry who report safety problems, environmental violations, or other illegal activities. Essentially, it says that companies can't fire, demote, or punish employees for speaking up about dangerous or illegal practices related to offshore drilling operations.

The bill covers a wide range of whistleblowing activities. Workers are protected if they report violations of federal offshore drilling laws to their employer or government officials, testify in court or before Congress about violations, refuse to participate in unsafe or illegal activities, report injuries or unsafe conditions, or refuse to work if they reasonably believe it could cause injury or an environmental disaster like an oil spill. The law applies to anyone working on offshore drilling platforms or supporting these operations, including contractors and subcontractors.

If a worker believes they've been retaliated against for whistleblowing, they can file a complaint with the Department of Labor within 180 days. The department then has 90 days to investigate and determine if there's reasonable cause to believe retaliation occurred. If the department finds in the worker's favor, it can order the company to reinstate the employee, pay double back pay plus interest, remove negative records from the employee's file, and pay damages. Workers can also take their case to court if the Department of Labor takes too long to decide. Companies that ignore these orders can face additional lawsuits and penalties. The bill also requires employers to post notices about these rights and train employees about their protections at least once a year.

Offshore Oil and Gas Worker Whistleblower Protection Act This bill prohibits an employer from discharging or discriminating against employees working in waters above the Outer Continental Shelf who report or testify about violations of the Outer Continental Shelf Lands Act, including about unsafe conditions or the adequacy of any oil spill response plan required by law. The bill establishes procedures for the filing, investigation, and adjudication of a whistle-blower complaint. Additionally, employers are required to <UL> <LI>post a notice approved by the Department of Labor explaining employee rights and remedies in a conspicuous workplace location; <LI>provide training to employees about their rights within 30 days of employment, and at least once every 12 months thereafter; and <LI>provide employees with a card containing a toll-free telephone number for obtaining information or for filing a complaint. </UL>
