The TASK Act requires publicly traded companies to disclose detailed information about their supply chains and business dealings, particularly those connected to forced labor concerns in China. Specifically, companies must report on their sourcing practices and due diligence efforts for products imported into the U.S. that are linked to forced labor from Xinjiang, China. They also must disclose any transactions with companies that the U.S. Department of Commerce has blacklisted or that the Treasury Department has identified as part of China's military-industrial complex. For American companies operating facilities in China, there's an additional annual reporting requirement: they must disclose whether a Chinese Communist Party committee operates within their company and provide a summary of any decisions or actions that committee may have influenced. The Securities and Exchange Commission (SEC) will establish and enforce these reporting requirements as part of its broader guidance on environmental, social, and governance reporting for publicly traded companies. Essentially, this bill aims to increase transparency so investors and the public can see which American companies have supply chain or operational ties to forced labor, sanctioned Chinese entities, or direct CCP involvement.
