Right now, the Department of Education can take money directly from people's paychecks if they owe federal student loans—a process called wage garnishment. This bill puts the brakes on that power. Starting immediately when the bill becomes law, the Education Secretary can no longer garnish wages from student loan borrowers. However, this suspension isn't permanent. After at least one year, the Secretary can restart the program, but only if they first prove to Congress that they've fixed serious problems with how the system works. Specifically, they need to show they can quickly refund people who were wrongly garnished (within one week), that they can stop the program whenever they want, and that they're checking with employers every three months to make sure all the information is correct. If the Secretary can't meet these requirements, the wage garnishment program ends for good. The bill also adds new protections: employers who keep taking money from paychecks after being told to stop can be sued for double the amount wrongly withheld, plus damages and attorney fees. Additionally, if the Department mistakenly garnishes someone's wages, they have to pay that person back twice the amount within 10 days. Finally, the bill prevents the government from garnishing wages for student loans that are more than 10 years old.
