This bill would allow the Department of Defense to skip major environmental protection laws when conducting military activities related to countering threats from China. Specifically, the Defense Department, its contractors, and partners could bypass requirements under four major environmental laws: the National Environmental Policy Act (which requires environmental impact studies), the Endangered Species Act (which protects wildlife), the Marine Mammal Protection Act (which protects ocean mammals), and the Federal Water Pollution Control Act (which regulates water pollution). The exemption would apply to military readiness, training, construction of military facilities, development and testing of weapons systems, and commercial technology projects tied to national security. Once the President or Secretary of Defense certifies that an activity relates to countering China, the military could proceed without environmental reviews, permits, or evaluations that would normally be required. The bill also prevents courts from reviewing or stopping these exempted activities. Importantly, this exemption would apply retroactively to military projects already underway, potentially canceling lawsuits and administrative cases currently challenging military activities on environmental grounds.
