When a drug company applies to the FDA to sell a new medication, they must now certify that any information they give to the FDA about the drug's chemistry, manufacturing, or how it works is the same information they gave to the Patent Office. Similarly, they must share with the Patent Office any information they submitted to the FDA that could affect whether a patent should be granted. The goal is to prevent companies from telling different stories to different agencies—for example, claiming a drug works one way to get FDA approval but describing it differently to get a broader patent.

The law applies to both traditional drugs and biological products like vaccines and gene therapies. It includes a new legal defense: if a drug company fails to properly share this information with the Patent Office, competitors can use that failure as a defense if the company later sues them for patent infringement. This creates an incentive for companies to be honest and consistent. The law also protects trade secrets—information shared between agencies stays confidential and isn't made public. The requirements kick in for new drug applications filed after the law passes, though older drugs are covered for any new patents issued after the law takes effect.
