The FAST Justice Act addresses a major backlog problem at the Merit Systems Protection Board (MSPB), which is the agency that handles appeals from federal employees and job applicants who believe they've been treated unfairly. Right now, these appeals can take years to resolve, leaving people in limbo about their employment status.

This bill creates a new rule: if the MSPB hasn't made a decision on your appeal within 120 days, you can skip waiting for them and take your case directly to federal court instead. This gives federal employees and applicants a way out of endless delays. You'd be able to file your lawsuit in any federal district court where the job action happened, where you would have worked, or where the agency's main office is located. The court would use the same standards the MSPB would have used to review your case, so you're not getting a different type of review—just a faster one.

If you do file in court, the MSPB has to pause your appeal with them. However, if the court decides it doesn't have the authority to hear your case, your MSPB appeal automatically starts moving again. The bill doesn't prevent you from going through the normal MSPB appeal process if you want to—it just gives you an alternative when things are taking too long.
