This bill makes nitazenes—a dangerous class of synthetic opioids—permanently illegal under federal law. Nitazenes are powerful drugs that were first created in the 1950s and are now showing up in illegal drug supplies across the country, contributing to overdose deaths. Some nitazenes are even more potent than fentanyl, which is already a major driver of the overdose crisis.

Right now, the Drug Enforcement Administration has only temporarily banned certain nitazenes on a case-by-case basis. This bill takes a broader approach by permanently scheduling the entire class of nitazenes as Schedule I controlled substances—the most restrictive category, meaning they have no accepted medical use and high abuse potential. This permanent ban would cover not just the nitazenes that currently exist, but also any new variations that drug manufacturers might create in the future by slightly changing the chemical structure.

The practical effect is that possessing, manufacturing, or distributing nitazenes would become a serious federal crime. Law enforcement would have clearer authority to prosecute nitazene-related offenses, and the government could more easily prevent new designer versions from entering the illegal drug market. The bill also preserves the ability for legitimate researchers to study these drugs if they get proper government approval, which could help develop better treatments for opioid addiction.
