The HUSTLE Act creates special tax-advantaged savings accounts called NIL investment accounts for college athletes who earn money from their name, image, and likeness (NIL). This includes income from endorsements, social media content, appearances, and similar deals.

Here's how it works: College athletes at participating schools can contribute their NIL income to these accounts and avoid paying taxes on that money when they contribute it. The money can grow tax-free inside the account. When athletes withdraw the money after graduating or transferring schools, they'll pay taxes on it—but at favorable long-term capital gains rates if they wait until after graduation. Athletes can contribute up to a certain annual limit (matching current education savings account limits) and can only use these accounts for five years while in school. If they leave school early or transfer to a non-participating school, early withdrawals are taxed as regular income plus a penalty.

The accounts have legitimate uses beyond just saving money. Athletes can withdraw funds penalty-free for qualified expenses like career transition costs (professional training, moving expenses for new jobs), higher education expenses, and medical bills. The bill also lets athletes convert these accounts into retirement accounts once they stop playing sports, allowing them to save for their long-term future.

Additionally, the bill strengthens rules around athlete agents who negotiate NIL deals. Agents must now register with their state, can't charge more than 5 percent commission on endorsement contracts, and face new restrictions on how they recruit athletes. Athletic associations must maintain public databases of registered agents, and student athletes gain the right to sue agents who violate these rules.
