This bill makes it easier and faster for the federal government to deport immigrants who have criminal convictions. Currently, the government can only deport immigrants for serious crimes like aggravated felonies. This bill expands that to include any felony conviction or any two misdemeanor convictions—meaning someone could face deportation for relatively minor crimes. The bill requires state and local courts and police to report every criminal conviction of non-citizens to federal immigration authorities within 24 hours. Once the federal government is notified, it must automatically start deportation proceedings. The bill also speeds up the deportation process by requiring immigration courts to prioritize these criminal cases and resolve appeals within 120 days instead of the current longer timeframes. To encourage cooperation, the bill offers $150 million annually in grants to states and local governments that work with federal immigration enforcement. However, states and cities that have policies limiting cooperation with immigration authorities—called "sanctuary jurisdictions"—will lose 15 percent of their federal highway funding unless they change their policies within 180 days. This creates significant financial pressure on local governments to comply with federal immigration enforcement.
